Heartbits Terms of Service

Welcome to Heartbits.

These Terms of Service (the "Terms") govern your access to and use of Heartbits and its related services, including the Heartbits website, applications, interfaces, features, content, and related products (collectively, the "Services").

Please read these Terms carefully before you register for, access, or use the Services. By registering for, accessing, or using the Services, or by otherwise indicating your acceptance, you agree to be bound by these Terms. If you do not agree to these Terms, you must stop using the Services immediately.

In these Terms, "Heartbits," "we," "us," and "our" refer to the provider of the Services. "You" and "user" mean the individual or entity using the Services.

1. The Services

Heartbits is an AI character and interactive storytelling platform for chats, images, videos, and microdramas. Depending on your plan and the features available at the relevant time, the Services may include AI character chat, original character creation, image and video requests, microdramas, and related discovery and social features.

The specific features and scope of the Services are as displayed and made available at the relevant time.

We may modify, update, suspend, limit, expand, discontinue, or remove any part of the Services at any time for operational, technical, legal, compliance, security, or other reasonable reasons. Where a change materially affects your core use of the Services, we will make reasonable efforts to provide notice.

2. Account Registration and Use

You may need to create an account to use certain features of the Services. You agree to provide accurate, current, and complete registration information, and to keep that information updated.

When you create an account, you must confirm that you are at least 18 years old and that you agree to these Terms and our Privacy Policy. We may decline, suspend, or terminate registrations that do not include this confirmation.

You are responsible for maintaining the confidentiality of your account credentials, including your password, verification codes, and any other login information. You are responsible for all activities that occur under your account unless caused directly by our failure to use reasonable security measures.

If you believe your account has been accessed without authorization or that there is any other security issue, you must contact us promptly at contact@heartbits.ai.

You may not:

  • impersonate another person or entity;

  • register or use an account with false or misleading information, including false age information;

  • sell, rent, transfer, share, or otherwise make your account available to an unauthorized third party; or

  • use scripts, bots, automation, bulk registration methods, or abusive technical means to obtain accounts or access the Services.

3. Age Requirements

You must be at least 18 years old to create an account or use Heartbits.

By creating an account or using Heartbits, you confirm that you are at least 18 years old.

If the laws in your jurisdiction require a higher minimum age to use the Services, you must meet that higher age requirement.

Heartbits is not intended for anyone under 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will take reasonable steps to delete it.

We may verify or re-confirm your age at any time, and we may suspend or terminate any account that does not meet these age requirements. If you believe that a person under 18 has provided information to us, please contact us at contact@heartbits.ai.

4. Plans, Diamonds, and Payments

Some features of the Services are available at no cost, while others require a paid plan, Diamonds, or both. A paid plan unlocks premium features. Some actions use Diamonds.

Diamonds are the only virtual item used within the Services. Prices, the number of Diamonds granted by a plan, and the number of Diamonds required for any action are shown in the product at the point of purchase or at the point of use, and those displayed values govern.

Diamonds included with paid plans are issued upfront after each successful payment: 100 Diamonds on Monthly, 300 Diamonds on Quarterly, and 1,200 Diamonds on Annual.

Diamond packs are one-time Diamond purchases available to subscribers with an active paid plan.

Diamonds do not expire. Unused Diamonds remain in your balance unless the related payment is refunded or reversed, or unless your account is terminated in accordance with these Terms. Diamonds have no cash value, are not a currency, stored-value instrument, or property right, and cannot be exchanged, transferred, resold, or redeemed for cash except where required by applicable law.

Subscriptions renew automatically until canceled. You can turn off auto-renew in Account; access continues through the end of your paid term. Turning off auto-renew does not retroactively cancel a completed payment.

By purchasing a paid plan, a Diamond pack, or any other paid feature, you agree to pay the fees shown to you at the time of purchase. Except where required by applicable law or expressly stated otherwise, payments are non-refundable. Where a payment is refunded, reversed, or charged back, we may deduct the corresponding Diamonds from your balance and restrict access to the related features.

If your purchase is processed through a third-party app store, payment processor, or platform, your payment, renewal, cancellation, and refund rights may also be subject to that third party's rules. We are not responsible for losses caused by third-party payment systems, but we will make reasonable efforts to assist where appropriate.

We may change pricing, plan benefits, Diamond grants, or billing models from time to time. If a change affects a future renewal or a new purchase, we will provide reasonable notice where required.

5. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal or internal lawful use.

Except as expressly permitted by law or by us in writing, you may not:

  • copy, reproduce, distribute, sell, lease, sublicense, or commercially exploit any part of the Services;

  • reverse engineer, decompile, disassemble, decode, or attempt to derive source code, models, parameters, algorithms, or internal logic from the Services;

  • bypass, disable, interfere with, or circumvent access controls, safety systems, moderation rules, rate limits, security features, Diamond deductions, or billing mechanisms;

  • use crawlers, scraping tools, bots, automated systems, or abnormal traffic methods to access the Services; or

  • interfere with or disrupt the integrity, performance, or normal operation of the Services or related systems.

6. User Content and Acceptable Use

You are solely responsible for any text, prompts, images, audio, video, links, files, instructions, characters, or other content that you submit, upload, generate, transmit, share, or otherwise make available through the Services ("User Content").

You represent and warrant that your User Content and your use of the Services will not:

  • violate any applicable law or regulation;

  • infringe, misappropriate, or otherwise violate the intellectual property, privacy, publicity, data protection, or other rights of any person or entity, including the use of a real person's name, likeness, or voice without authorization;

  • include fraudulent, deceptive, defamatory, harassing, abusive, threatening, hateful, discriminatory, violent, or otherwise harmful content;

  • contain malware, viruses, malicious code, or other harmful components;

  • be used for spam, scams, bulk messaging, cheating, manipulation, abuse, evasion of safeguards, or other improper purposes; or

  • facilitate, encourage, instruct, or promote illegal or dangerous activity.

We may, but are not obligated to, review, monitor, remove, restrict, or disable access to User Content or accounts where we believe there may be a violation of these Terms, applicable law, platform policies, safety requirements, or the rights of others.

7. Zero Tolerance for Pornographic and Obscene Content

Heartbits does not provide, promote, or permit pornographic, obscene, sexually explicit, sexually exploitative, or similarly inappropriate content.

You may not use the Services to create, request, upload, submit, generate, transmit, or share content that includes or relates to:

  • pornography, obscenity, explicit sexual acts, or content primarily intended for sexual arousal;

  • sexual content involving minors, suspected minors, or age-ambiguous characters;

  • sexual exploitation, sexual violence, coercion, incest, bestiality, or any other unlawful or abusive sexual content; or

  • attempts to evade these restrictions through coded language, roleplay framing, fictional setups, indirect prompts, or similar methods.

If we detect such conduct, we may immediately remove the content and take action including warnings, feature restrictions, suspension, termination, account bans, and reporting to relevant authorities where appropriate, without liability to you.

8. AI Characters and AI-Generated Content

Characters on Heartbits are AI characters, not real people. When you open a character chat, you are chatting with an AI character, and responses and media may be AI-generated. Any personality, backstory, or relationship setting is fictional and is presented for interactive storytelling and roleplay purposes only.

AI-generated output may be inaccurate, incomplete, outdated, biased, misleading, or otherwise unsuitable for your intended use.

AI-generated content is provided for general informational, creative, conversational, or assistive purposes only and does not constitute professional advice, factual guarantees, or binding commitments. The Services are not a substitute for human relationships and do not provide medical, mental health, or crisis support.

You are responsible for evaluating and verifying any output before relying on it. You must not rely solely on the Services for medical, mental health, legal, financial, investment, employment, education, safety-critical, or other high-impact decisions.

You may not use the Services or any output from the Services for unlawful purposes, impersonation, deception, fraud, harassment, deepfake abuse, rights violations, or the distribution of harmful content.

9. Intellectual Property

The Services, including their software, models, interfaces, design, text, graphics, logos, trademarks, audio, video, code, data organization, and other content, are owned by us or our licensors and are protected by applicable intellectual property and other laws.

As between you and us, you retain any rights you own in your User Content. However, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify, transmit, display, and use your User Content to the extent reasonably necessary to operate, maintain, secure, improve, moderate, investigate, and provide the Services, to comply with legal obligations, and to display content you choose to make available through the Services.

If you provide feedback, suggestions, ideas, or proposed improvements regarding the Services, you agree that we may use them without restriction or compensation to you, unless prohibited by applicable law.

10. Privacy and Data

We value privacy and the protection of personal information. Our collection, use, storage, sharing, and protection of personal information will be described in our Privacy Policy and related notices, as updated from time to time.

You understand that no internet or electronic storage system is completely secure. While we take reasonable measures to protect the Services and related data, we cannot guarantee absolute security.

We may process technical logs, device information, usage data, error reports, content signals, age-confirmation records, and related information as reasonably necessary to operate the Services, prevent abuse, maintain security, troubleshoot issues, improve performance, and comply with legal obligations.

11. Third-Party Services

The Services may integrate with or rely on third-party websites, app stores, payment providers, login providers, cloud infrastructure, or other services. Those third-party services are provided independently and may be governed by separate terms and privacy policies.

We are not responsible for the availability, security, content, or practices of third-party services. However, where an issue directly affects your use of Heartbits, we may try to assist in a reasonable manner.

12. Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, if:

  • you violate these Terms or applicable law;

  • you do not meet the age requirements in Section 3;

  • your conduct creates legal, security, reputational, or operational risk for us, other users, or third parties;

  • information associated with your account is false, misleading, incomplete, or suspicious;

  • suspension is required for safety, compliance, technical maintenance, abuse prevention, or legal reasons; or

  • we otherwise determine in good faith that such action is reasonably necessary.

You may stop using the Services at any time and may request account deletion where that functionality is made available. After termination, we may retain certain data as required or permitted by law, for legitimate business purposes, or for security, audit, and dispute-resolution purposes.

Unless required by applicable law, any unused Diamonds are forfeited when an account is terminated for a violation of these Terms.

13. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or reliability.

We do not warrant that:

  • the Services will be uninterrupted, timely, secure, or error-free;

  • any output or result will be accurate, lawful, reliable, or suitable for your intended purpose;

  • the Services will be available in all regions or compatible with all devices, systems, browsers, or networks; or

  • defects will always be corrected.

To the extent permitted by law, we are not liable for losses arising from your use of or inability to use the Services, reliance on any content or output, third-party conduct, network failures, service interruptions, malware, hacking, government actions, force majeure events, or other events outside our reasonable control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities, arising out of or related to the Services or these Terms.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:

  • the total amount you paid us for the relevant Services during the 12 months before the event giving rise to the claim; or

  • USD 100, if you have not made any payments to us.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Heartbits, the provider of the Services, and its related contractors and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use of the Services;

  • your User Content;

  • your violation of these Terms or applicable law; or

  • your infringement of any rights of a third party.

16. Changes to These Terms

We may modify these Terms from time to time to reflect legal, regulatory, operational, product, or business changes. Updated Terms will become effective when posted or on the effective date stated in the updated version.

If a change materially affects your rights or obligations, we will make reasonable efforts to provide notice where required. Your continued use of the Services after the updated Terms take effect means you accept the revised Terms. If you do not agree, you must stop using the Services.

17. Governing Law and Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be governed by the laws applicable to the provider of the Services, excluding conflict of laws rules. If mandatory consumer protection laws in your jurisdiction apply, those mandatory protections will prevail to the extent required.

If a dispute arises, both parties agree to first attempt to resolve it in good faith through informal discussion by contacting us at contact@heartbits.ai. If the dispute is not resolved within a reasonable period, then, unless otherwise required by applicable law, the dispute will be submitted to a court of competent jurisdiction.

19. Miscellaneous

These Terms constitute the entire agreement between you and us regarding your use of the Services and supersede any prior or contemporaneous understandings relating to the Services.

If any provision of these Terms is found unenforceable or invalid, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
